Republic of Yemen Ministry 0f Legal Affairs Republican Resolution No (155) of 1995 Concerning Establishing of National Information Center and Its
Adjustment by the Republican Resolution No (244) of 1998 and by the Republican
Resolution No (412) of 1999 President of the Republic, After having perused the constitution of the Republic of Yemen and the
Republican Resolution No. (1) of 1994 concerning the Formation of the Cabinet
of ministers and pursuant to the Prime Minister' offer We resolve the following: Citations and Definitions A
center is established in accordance with this resolution nominated "The
National Information Center" which headquarter to be in the
capital Sana'a and attached to the Presidency of the Republic. Article
(2): The
center enjoys a legal personality and independent financial entity. Article
(3): For the application of provisions of this resolution the
terms and expressions mentioned hereunder shall have the meanings before each
of them unless the context indicates the contrary: REPUBLIC

Section Two Principal Objectives, functions and powers Article
(4): The center aims to establish, develop and manage a
comprehensive national information system connecting the information center
in different sectors and coordinate between them within a national network
through which data and information are provided to different sectors, the
concerned persons'and decision makers to assist the preparation, execution,
follow-up, evaluation and development or plans, programs and policies in
various fields to raise the standard of administrative. Organizational.
Scientific and productive activities efficiency and efficacy of different
kinds and fields in the Republic. Article
(5): To
realist its objectives the center undertakes practising the following
functions and powers: 1-
Provide the main bases of data and information at the national level through
data collection, treatment, keeping, analysis of data and information of different
forms, bases and sources mid follow-up regularity of its inflow, updating,
retrieval, and transmission 2-
Formulate unified standards and measures for the different technical
operations of data and information treatment and exchange at the national
level. 3- Acquisition and operation of the
most modern software and hardware used by information technology' to keep in
line with the technological development used' in this field. 4-Set
up a comprehensive system of information services through selective
information transmission to researchers, concerned persons and decision
makers and reply inquiries in accordance with regulatory measures set up by
the center. 5-
Conduct of surveys, researches and studies related to information sources and
systems inside or outside the Republic. 6-
Conduct workshops, conferences and participation there to inside and outside
the Republic. 7-
Issue of leaflets and periodicals related to information and diffusion of
national awareness of the importance and use of the information. 8-
Participate in transfer, application and development of information in the
Republic. 9-
Connect the center with information systems inside and outside the Republic,
establish and develop co-ordination and co-operation relationships with information
systems at the regional and international levels so as to make use of
experience and skills in this field. 10-
Formulate and implement comprehensive plans and programs to train, qualify
and develop staff members and those benefiting in information technology
field within the c, enter and The State Organizations. 11-
Conclude contracts and agreements necessary to run the works of the center,
develop its services, qualify and train its administrative cadre. 12-Found
a national information library. 13-
Utilize national and foreign specialized experts in accordance with policies
and rules set up by the center. 14-
Any other functions and powers needed by nature of center or being charged
thereof. Section Three Management of the center Article
(6): The
center is run by, the ffo11owing bodies: a)
Board
of Trustees. b)
The
President of the Center. Article
(7): The
board of trustees is composed of a chairman and members among whom is the
center cheif, being elected of these having experience and ability', and
their nomination is made by issue of a republican decision. The
board is the supreme authority of the center having full powers of
monitoring, orienting, drawing policies and approval of plans and programs
aiming realization of the objectives of the center in the framework of
regulations, rules and decisions in force and having particularly rights to
practise the following functions and powers: a) Draw general
policies of the center. plans and program and follow-up implementation
thereof. b) Approval of the organizational and
internal rules regulating the different activities of the center. c) Forming advisory and technical
committees' permanent or temporary and fixing their duties. d) Propose project laws, rules and
decisions regulating information handling and protecting public and private
rights. e) Approval of
agreements and contracts projects concluded by the center with other parties. f) Approval of
the annual budget project and the final accounts of the center. g) Discussion of issues and affairs
suggested by the chairman related to activities of the 'center. h) Any other functions or powers needed by
nature or functions of the center Article
(9): The
chairman assumes the following functions and powers: a) Invite to and
preside meetings of the board. b) Sign decisions and instructions issued
by the board and follow-up implementation. c) Assume
whatever powers delegated by the board. d) Assume any other
functions or powers be charged with or needed by nature of his functions and
work. Article
(10): The
chairman may delegate some of his powers to the President of the Center. Article
(11): The
board meets upon a written invitation from the chairman once a month at least
and meets extraordinarily whenever needed or suggested by the chairman or one
third of members of the board. a) The meeting
of the board is considered valid if attended by half of its members. b) Decisions and
proposals of the board are issued by the majority of the attending members
and in case of parity the side of the chairman outweighs. a) The President of
the Center is appointed of those having ability and specialization. b) The President of the Center shall have a
minister's degree and shall be appointed by a Republican decision. c) The President of the Center is directly
responsible towards the chairman and members of the board about all activities
of the center. Article
(14): The
President of the Center assumes the following functions and powers' a) Manage the
center and run its technical, financial and administrative affairs. b) Propose and submit plans, programs and
rules to the board for approval. c) Implement decisions of the board. d) Submit appropriate proposals to develop
the technical and administrative work in the center. e) Sign contracts and agreements concluded
by the center after being approved as projects by the board. f) Submit reports related to the level of
implementation of works, activities and performance evaluation of the center. g) Co-ordinate works
and activities of the center with different authorities. h) Prepare the annual budget project and
monitor implementation after approval of the concerned authority. i) Prepare the final accounts and submit
to the chairman for approval. j) Propose the meetings agenda and submit
to the chairman for approval. l) Any other
functions or powers charged with by the board or 'the chairman in accordance
with provisions of laws in force. A-The Vice President of the center is
appointed of those having ability, specialization, have deputy minister grade
and shall be appointed by republican resolution according as prime minister's
offer. B-
The Vice President should undertakes the following functions and powers: 1-Assist
the Center President in his function and powers. 2-Perform
the Center President's functions and powers in case of his absence. 3-Implement
the duties which assigned to him from the Center President. 4-Supervise
details program preparation for executing the center's duties and follows the
execution operation. 5-Follow
the implementation of systematic procedures which have the ability to achieve
the functional control and facilitate work relations. 6-Any
other functions and powers charged with by the board or the chairman or the
Center President in accordance with provisions of laws in force. Section Four General and concluding provisions Article
(15): The
center shall have an independent budget attached to the presidency of the
Republic office and disbursements there from are subject to the center cheif
patronage in accordance with regulating rules and bylaws. Article
(16): The
internal bylaw regulates rights, duties and remunerations of employees of the
center and shall be issued by a decision of the Prime Minister pursuant to a
proposal by the chairman of the board of trustees and subject to approval of
the board. Article
(17): The
internal bylaw of the center shall be issued by decision of the Prime
Minister pursuant to a proposal by the chairman of the board of trustees and
subject to approval of the board. Article
(18): All
public administrative units, public sector units, mixed sector units and private
sector units should provide the center with all data and information required
and necessary to practise its functions and powers. Article
(19): This
resolution shall come into force from the date of its issue and shall be
published in the official gazette. Issued
